Terms and Conditions
Acceptance: It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Work: The Service Provider agrees to produce project materials (the “Work”) at the request of the client for fees agreed upon in advance and delivery of the Work by an agreed-upon deadline. The Service Provider agrees that he will be the author of the Work, which will be original work and free of plagiarism.The Service Provider will cooperate with Client in editing and otherwise reviewing the Work prior to completion and launch.
Confidentiality: The Service Provider acknowledges that he may receive or have access to information which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. Service Provider agrees to protect the confidentiality of the Client’s proprietary information and all physical forms thereof, whether disclosed to the Service Provider before an Agreement is signed or afterward. Unless strict confidentiality is requested by Client in advance of the establishment of this contract, the Service provider can display materials and final work created for Client on the Service provider’s website (https://www.paperconestudios.co.za).
Non Completion: The Service Provider will not be held liable for failing to complete any project on a specific deadline date, due to lack of participation from the client or late submission of content from the client.
Client Approval: Upon acceptance of the Work, the Client accepts responsibility for any further processes in which this work is used (e.g. film outpost, printing, etc.) the Service Provider is not responsible for errors occurring in this work or projects related to this work after acceptance of the Work by the Client.
Invoicing: Clients will receive computer generated invoices for all services rendered by the service provider. All computer generated invoices and credit notes will be sent to clients via electronic means and will include payment instructions/options and bank details.
Compensation: The Client agrees to pay the Service Provider 50% of the total project cost before any services are provided, and the remaining 50% is to be paid before any workable files are delivered. If the parameters of the Work change, or if it involves more time than estimated, the service Provider will inform the Client and they can renegotiate the Work’s cost.
Cancellation: Both parties understand that the Client or Service Provider may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written cancellation, the Client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed that is determined by the Service Provider. Should the Client cancel the project following its completion, the Client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, the Service Provider retains ownership of all copyrights and original work created.
All changes, additions, approvals, etc. MUST be done via email, this is for both the Service Provider and the client’s protection, clarification and referral purposes.
